"The Customer," "You," and "Your" denote the customer of Safeguard Protects One LLC - General Ltd whose particulars and information are delineated in the contract.
1.3. "The Provisions" encompass the services rendered by Safeguard Protects One LLC - General to the Customer, including credit control, debt recovery, legal and tracing services, along with additional services like management reports, professional guidance, and all aspects related to the oversight and management of credit accounts. 1.4. "The Information" signifies any data supplied by the Customer or any of the Customer’s clients, comprising debtor details and particulars regarding the debts of the Customer’s clients.
Our Arrangement 2.1.
These stipulations, coupled with the contractual agreement and Service Level Agreement, constitute the entire understanding between You and Safeguard Protects One LLC - General to the exclusion of any provisions imposed by You within any other pact, superseding any previous agreements concerning the services, whilst reserving the rights acquired by each party.
2.2. Alterations to the terms and conditions may occur through Promotional Terms and Conditions. No modifications are binding unless endorsed in writing by a director on behalf of Safeguard Protects One LLC -
General. 2.3.
In instances where Promotional Terms and Conditions conflict with these terms and conditions, the former shall take precedence.
2.4. No personnel or representatives of Safeguard Protects One LLC - General are authorized to make service-related statements without written confirmation from the company. The Customer acknowledges not relying on any unconfirmed representations, thereby waiving any claims for a breach of such representations.
2.5. Notice of Claim: The Customer must report any and all claims for loss or damage to the Carrier in writing within twenty four hours of delivery. Failure to report a claim within this timeframe may result in denial of coverage.
2.6. Burden of Proof: The Customer shall bear the sole burden of proving by a preponderance of the evidence that the loss or damage to Covered Property occurred during the transportation or storage period and was caused solely by the acts or omissions of the Carrier.
2.7.Covered Property: This policy excludes coverage for the following items: jewelry, firearms, antiques, artwork, and collectibles. Coverage for these items can be purchased separately with a special valuation rider. Additionally, this policy excludes coverage for loss or damage caused by pre-existing conditions, inherent vice, or mechanical malfunctions.
2.8. Documentation Requirements: In order for a claim to be considered, the Customer must submit a detailed inventory list of all Covered Property, including photographs of each item taken from multiple angles with clear timestamps, along with written descriptions including dimensions, material, and any identifying marks.
Our Offerings 3.1.
Safeguard Protects One LLC - General is accountable for uploading Data to the system if provided in the agreed format exclusively.
3.2. By authorizing us, You allow Safeguard Protects One LLC - General to act at its discretion regarding referred debts, engaging collection agents on Your behalf. Any engagement with collection agents appointed by us necessitates prior written consent. Payments for referred debts and issuance of receipts are authorized to be handled by us and our agents.
3.3. Timely service provision by the Company is contingent on receipt of the Customer’s data and resolution of queries by the customer, thus maintaining a service pace directed by the Customer.
3.4. Except as otherwise directed by You, consultations are typically conducted before commencing legal actions.
3.5. We retain the right to reject actions for collecting a debtor or halt the collection of any specified debt upon notification to You.
Your Responsibilities 4.1.
You affirm that all debts referred to Safeguard Protects - General for recovery services are authentic, precise, valid, and comprehensive. Safeguard Protects One LLC - General bears no liability for any ensuing loss or damage triggered by the services provided.
4.2. Immediate notification to us is essential regarding any monies, offers, or correspondences received directly from debtors by You, Your agents, or bankers.
4.3. Your agreement not to alter the terms of a contract with a debtor, or assign/transmit any referred debt without prior consent from us, is hereby acknowledged.
Fees and Levies 5.1.
All payments under these terms are exclusive of VAT and other levies. The prevalent rate of VAT and other duties applies.
5.2. The Customer is accountable for and must pay all court fees, fixed costs relating to solicitors’ charges, or charges of collection agents up to service agreement termination.
5.3. Timely payments, in full without deduction, must be made within 7 days of the invoice date. Statutory interest and charges apply to overdue invoices.
5.4. We retain the right to offset our charges.
